Guide to EUIPO trademark registration in the European Union
One Application, 27 Countries: Trademark Protection in Europe EUIPO trademark registration is handled through a single EU-wide application filed with the European Union Intellectual Property Office. One application can secure trademark rights in all 27 European Union member states, which can make the process considerably easier in terms of both cost and management. Based on EUIPO's official fee schedule and filing procedures, this guide explains step by step how to register your trademark for the European market.

1. Advantages of a European Trademark Registration
- One application, 27 countries: protection that applies at the same time in markets such as Germany, France, the Netherlands and Italy.
- One language: the application can be filed in one of several official EU languages, including English.
- Lower total cost: significant savings compared with filing separately in each country.
- Online and transparent system: applications can be filed online and tracked through the EUIPO system.
2. The EUIPO Trademark Registration Process (Step by Step)
a. Trademark Clearance Search (Optional but recommended)
It is important to check whether your trademark has already been registered in the EUIPO system or in national trademark databases. EUIPO's TMView tool can be used for this.
b. Choosing the Trademark Classes (Nice Classification)
The classes describing the goods and/or services your trademark will cover need to be determined. The first class is included in the official fee; additional classes carry an extra fee.
c. Preparing the Trademark Application
The application includes the following information:
- Trademark name
- Trademark type (word, figurative, color, etc.)
- Applicant details
- Selected class(es)
- First language choice
- Fee payment (credit card or bank transfer)
d. Filing the Application and Payment
The application is filed through the EUIPO portal. It is not processed until payment is made.
e. Examination
EUIPO examines the application on formal and substantive grounds against its registrability criteria. This stage usually takes 1-2 months.
f. Publication and Opposition Period
Applications that pass examination are published in the EUIPO Trade Marks Bulletin. For 3 months from publication, third parties may file an opposition against the trademark.
g. Registration Decision
If no opposition is filed, the trademark is registered and the registration certificate is sent to the applicant. Registration is valid for 10 years and can be renewed.
3. EU Trademark Application Fees (EUIPO)
| Number of Classes | Total Official Fee (EUR) |
| 1 class | 850 € |
| 2 classes | 900 € |
| 3 classes | 1.050 € |
| 4 classes or more | 1,200 € + 150 € for each additional class |
Example: total official fee for an application covering 5 classes:
850 € + 50 € (2nd class) + 150 € (3rd) + 150 € (4th) + 150 € (5th) = 1,350 €

4. The “Use Requirement” and the 5-Year Grace Period in EUIPO Trademark Registration
A trademark registered with the European Union Intellectual Property Office (EUIPO) does not need to be in active use at the time of filing. In other words, you do not need to submit any sales records, invoices or visual proof when you apply. This can be a real advantage, especially for new ventures and for brands that are still preparing to launch on Amazon.
This advantage has a limit, though. Under the EUIPO system, the first 5 years after registration are treated as a grace period for use. During this period your protection remains valid even if the mark is not used in any commercial activity. At the end of the 5 years, however, you should be able to show genuine commercial use of the mark. This proof should be supported by commercial records such as product packaging, Amazon product pages, invoiced transactions, social media campaigns or advertising materials.
If a competitor files a cancellation action claiming that your mark is not in use, you will need to prove that use. Otherwise, the mark may face a risk of cancellation.

5. Why EUIPO Trademark Registration Matters for Selling on Amazon in Europe
For sellers planning to sell on Amazon’s European marketplaces (Amazon.de, Amazon.fr, Amazon.it and others), an EUIPO trademark registration offers a clear advantage. For Brand Registry applications in Europe, Amazon accepts only valid trademark registrations issued by a national office or through EUIPO. Because a single EUIPO application provides protection in 27 countries, it removes the need to file separately in each country. This can make the brand protection process both faster and considerably more cost-effective.
In addition, unlike a USPTO application in the U.S., an EUIPO registration does not require a specimen of use. This means you can secure your brand even if your product is not on sale yet. That flexibility is especially useful for Amazon Europe projects that are still in the launch phase. After registration, Amazon’s brand protection tools (infringement reports, A+ Content, Sponsored Brands ads and more) become available, which can improve your product’s visibility and credibility.
